Mellie, Inc. (“Mellie” or “us”, “our”, “we”) respects your right to privacy. Your ability to make informed choices about the uses of your information is important to us. BY ACCESSING AND/OR USING THE SITE AND SOLUTION, YOU ARE ACKNOWLEDGING THAT YOU HAVE READ AND AGREE TO THE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE USING THE SITE AND SOLUTION.
As used in this privacy policy, “Personal Data” means information that can be directly associated with a specific person or entity, such as a name, address, date of birth, or e-mail address. The term “Personal Data” includes any information that can be used on its own or with other information in combination to identify or contact one of our users. Some of the Personal Data we collect and transmit may be considered “health data” (i.e., data related to your physical or mental health).
Information We Collect
Mellie collects two general types of Personal Data: (a) data from persons who visit the Site (the “Site Data”); and (b) data concerning users of its Solution (the “Solution Data”). Such users of the Solution may be direct paying customers of Mellie. They also may be the personnel of Mellie’s business/corporate customers (the “Customers”). The Customers enter into agreements with us and sign up their personnel to use the Solution. Additional users may be other care givers of the elderly person.
Site Data will include certain data which we will collect automatically, such as your IP address, mobile device or computer, operating system and browser, screen resolution, page views, clicks recorded sessions, and geo-location. In addition, we collect any information you provide when you contact us for any reason.
Solution Data is all data that is collected by means of our Solution. Mainly, Personal Data will be collected regarding the elderly person whose healthcare is being coordinated by his/her caregiver and related persons or service providers (together the “Care Team”). Such Personal Data includes name, address, contact details, health data, mental health data, well-being data, financial data, legal data, relationship data. However certain Personal Data will also be collected regarding the Care Team, such as their names, mobile number and contact details.
You are not required by law to provide us with any of the information described herein, but by using Solution and/or Site you agree to provide us with such information. By providing Personal Data regarding an elderly person, you hereby represent and warrant that you have obtained his/her consent to provide his/her Personal Data in connection with our services and Solution, including without limitation, the types of sharing of such Personal Data with other persons and parties as described hereunder.
How We Use Information
We will not share your Personal Data with third parties without your explicit permission, except when required by law, regulation, subpoena or court order or as otherwise expressly set forth herein. We may use Personal Data and other information internally – for example, to provide you with goods and services, to help diagnose problems with our servers, and to make our products, the Site and/or Solution more useful for you and for our other customers.
More specifically, Mellie processes your Personal Data for the following legitimate business purposes:

Solution Data and related analyses will be shared with the applicable Customer and its personnel.
Solution Data may be shared amongst the Care Team.
Additionally, we may share your Personal Data with:

members of our corporate family, or third party vendors or service providers, such as email service providers sending emails on our behalf. We may also authorize third party vendors or service providers to collect information on our behalf. We will require members of our corporate family, third party vendors and applicable service providers to follow practices that protect your privacy rights on a level at least as restrictive as the practices described in this Privacy Policy.

Business partners with whom we may jointly offer products or services, or whose products or services may be offered on our website. You can tell when a third party is involved in a product or service because their name will appear, either alone or with ours. If you choose to use these products or services, we may share information about you, including your Personal Data, with those partners. Please note that we do not control the privacy practices of these third party business partners. If you wish to no longer allow that third party to use your information, please contact that third party directly.

Referring websites. If you were referred to this website from another website (for example, through a link), we may share some information about you with that referring website. We encourage you to review the privacy policies of any website that referred you here. Additionally, when you link to one of our partners from our Services, we provide that partner with a unique identifier so they know that you were referred from our Services. This unique identifier will not contain any of your Personal Data.
In addition, by analyzing all information we receive, we may compile statistical information across a variety of users (“Statistical Information”). Statistical Information helps understand trends and customer needs so that new products and services can be considered and so existing products and services can be tailored to customer desires. Statistical Information does not indicate individuals’ identities, and we will not link Statistical Information to any Personal Data. We may use Statistical Information indefinitely and we also may share Statistical Information with our partners, pursuant to commercial terms that we determine in our sole discretion. In addition, we may provide any information to third parties, so long as we have removed any information that identifies any particular individual or user, such as a name, address or contact information.
We may provide certain information including, but not limited to, Statistical Information, to Google Analytics or other analogous platforms, such as Hotjar, in order to receive an analysis of the use of our services. Google Analytics tools may collect the IP address assigned to you on the date you visit/use the services. We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotdjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our Site. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. How we Protect Information
We follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
Mellie stores Personal Data on secured servers and uses a combination of technical, administrative, and physical safeguards to protect your personal information. Such safeguards include, but are not limited to, authentication, encryption, backups, and access controls.
Cookies
A cookie is a small piece of text that is sent to a visitor's browser. The browser provides this piece of text to the device of the originating visitor when this visitor returns. A “persistent” cookie may be used to help save your settings and customizations across visits. Most Web browsers are initially configured to accept cookies, but you can change this setting so your browser either refuses all cookies or informs you when a cookie is being sent. Also, you are free to delete any existing cookies at any time. Please note that some features of the Solution and/or Site may not function properly when cookies are disabled or removed. We may use third party cookies. We may also use cookies for purposes of targeting and/or marketing.
How Long Does Mellie Retain Personal Data?
Mellie retains your Personal Data only as long as necessary and as required for our business operations, the provision of Services, archival purposes, and/or to satisfy legal requirements. The exact period of retention will depend on: (i) the amount, nature, and sensitivity of the Personal Data; (ii) the personal risk of harm for unauthorized use or disclosure; (iii) the purposes for which we process your Personal Data, including whether those purposes can be achieved through other means; and (iv) business operations and legal requirements. In general, Mellie strives to retain your data for no longer 24 months after your Account is closed (the “Retention Period”); however, the above factors may extend or decrease this Retention Period. can also request that we delete Personal Data, however we may retain such data as to comply with our legal obligations, resolve disputes, and enforce our agreements. At the end of the applicable Retention Period, we will remove your Personal Data from our databases and will require that our business partners remove any identifiable Personal Data from their databases. If there is any data that we are unable to delete entirely from our systems for technical reasons, we will put in place appropriate measures to prevent any further processing of such data. Please note that once we disclose your Personal Data to third parties, we may not be able to access that Personal Data and we cannot force the deletion or modification of such information by third parties.
Third Party Sites and Services
We may use third party payment providers to provide payment services on the Solution and/or Site. We are not affiliated with, and do not have any responsibility for the privacy practices of such third party payment services. Please review independently the privacy policies of such third party payment providers.
In addition, the Solution and/or Site may link to or using web sites or services belonging to third parties. We have no control over third-party sites or services, and all use of third-party sites or services is at your own risk. We cannot accept responsibility for the privacy policies of any such sites. We are not responsible for content available by means of such sites or services. We do not endorse any products or offered by third parties and we urge our users to exercise caution in using third-party sites or services.
Children
We do not knowingly collect Personal Data from children under the age of 13. In the event you become aware that an individual under the age of 13 has enrolled without parental permission, please advise us immediately.
Correcting or Updating your Information.

Communications
We may send you email or other messages about us or our products and services as well as messages about products and services of selected third parties. By accepting the Terms for the Solution and/or Site (including the terms of this Privacy Policy which are incorporated therein) or using the Solution and/or Site, you affirmatively consent to receive such commercial messages. As a registered member, you can remove your Personal Data from our mailing list and stop receiving future communication from us by following the unsubscribe link located at the bottom of each communication or by emailing us at info@mellie.comYou will also be given the opportunity to unsubscribe from commercial messages in any such email we send. Please note that we reserve the right to send you service related communications, including service announcements and administrative messages, relating either to your account or to your transactions on the Solution and/or Site, without offering you the opportunity to opt out of receiving them unless you cancel your account.
Other Uses or Transfer of Your Information
We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or behavior of any user suspected to have engaged in illegal behavior.
We may share your information with our affiliates. We may use subcontractors that are located in countries other than your own, and send them information we receive. For example, we may send your information to any countries outside your jurisdiction and/or outside the United States or the European Union. All our subcontractors will be subject to non-disclosure and non-use obligations. Nevertheless, some countries may have levels of protection of personal and other information which are not as high as in your country of residence or business.
We may transfer our databases containing your Personal Data if we sell our shares, business or part of it, including in cases of liquidation, and the terms of this Privacy Policy will continue to apply to the databases. Information about our users, including Personal Data, may be disclosed as part of, or during negotiations of, any merger, sale of company assets, spinoff, liquidation or acquisition and shall continue being subject to the provisions of this Privacy Policy. By providing such information, you expressly consent to such transfer and use, including transfers outside of the country of your residence.
Do Not Track Disclosure
Some web browsers may transmit do not track (“DNT”) signals to websites with which the user communicates. To date, there is no industry standard for DNT and users cannot know how a given company responds to a DNT signal they receive from browsers. Mellie is committed to remaining apprised of DNT standards. However, Mellie does not support DNT browser settings and does not currently participate in any DNT frameworks that would allow Mellie to respond to signals or other mechanisms regarding the collection of your personal information.
California Residents
If you are a California resident, the California Consumer Privacy Act (“CCPA”) may apply to you.
Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask for and obtain from us an annual list identifying the categories of personal customer information which we shared, if any, with our affiliates and/or third parties in the preceding calendar year for marketing purposes. We may update this privacy policy from time to time, and we encourage you to review it periodically. Any revisions to the Privacy Policy will be posted on www.mellie.com/privacy. Any changes to this Privacy Policy will be effective immediately upon providing notice via the website and will apply to all Personal Data that we maintain, use, and disclose.
